Terms of Service

1. Acceptance of Terms

By accessing or using Pixshop at pixshop.art, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the service.

2. Eligibility

You must be at least 18 years old to use Pixshop. By using Pixshop, you represent that you are 18 or older. Because the service processes biometric face data, we do not permit use by anyone under 18, regardless of jurisdiction. If you are using Pixshop on behalf of an organization, you also represent that you have authority to bind that organization to these Terms.

3. Account Registration

Accounts are created and managed through Clerk. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at pixshop@1nano.tech if you suspect unauthorized access.

4. Service Description

Pixshop is an AI-powered photo studio offering guided AI headshots, AI photo packs, and AI editing tools including text-to-image and reference-guided generation. These tools use AI models to transform your uploaded photos into new images. Results are AI-generated and may vary; they are not photographs.

6. User Content & License

You retain ownership of all photos and content you upload to Pixshop. By uploading content, you grant Pixshop a limited, non-exclusive, royalty-free license to process, store, and transmit that content solely for the purpose of providing the service to you. We do not use your uploaded content to train AI models.

Photos of other people. If you upload a photo that includes another person's face, you represent that you have obtained that person's explicit written consent to have their likeness processed by AI. Uploading photos of others without their consent is a violation of these Terms and may violate applicable law.

No minors. You must not upload any photo depicting a person under 18 years of age. This prohibition is absolute and applies to all tools and workflows on Pixshop.

7. Generated Content

Images generated by Pixshop are provided for your personal and commercial use. Pixshop does not claim ownership of AI-generated outputs. Generated images are not guaranteed to be unique — other users may receive similar outputs from similar inputs. You are responsible for ensuring your use of generated content complies with applicable laws.

8. Acceptable Use

You agree not to use Pixshop to:

• Generate sexually explicit, NSFW, or otherwise harmful content
• Generate or upload content depicting any person under 18
• Upload photos of another person without their explicit written consent
• Request race or ethnicity changes to a subject's appearance
• Impersonate another person or create deceptive deepfakes
• Harass, defame, or harm any individual
• Engage in fraud, political campaigning, or promotion of illegal products
• Attempt to circumvent safety filters or content policies
• Use automated bots, scrapers, or tools to access the service at scale without authorization
• Violate any applicable law or third-party rights

Violation of these rules may result in immediate account suspension or termination without refund.

9. Biometric Data Consent

By uploading a photo of your face, you acknowledge that Pixshop processes facial geometry and likeness data to generate AI images. Depending on your location, some of this information may constitute biometric data or sensitive personal data under applicable law. You expressly consent to this processing for the purpose of generating your requested images. Pixshop does not sell your biometric data. All facial data is deleted after 30 days per our Privacy Policy.

10. AI Disclaimers

Pixshop uses Google Gemini and other AI models to generate images. AI-generated results may be imperfect, unexpected, or inconsistent. Generated images are not photographs and should not be represented as such. Pixshop makes no guarantee of fitness for any particular purpose, including professional use cases. Use your judgment before publishing AI-generated content.

11. Intellectual Property

The Pixshop brand, logo, website design, underlying software, and technology are owned by Pixshop and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Pixshop platform without express written permission.

Copyright complaints (DMCA). If you believe that content on Pixshop infringes your copyright, please send a notice to pixshop@1nano.tech with the subject “DMCA Notice” including: (1) identification of the copyrighted work, (2) identification of the infringing material and its URL, (3) your contact information, (4) a good-faith statement that you believe the use is not authorized, and (5) a statement under penalty of perjury that the information is accurate and you are authorized to act.

12. Data & Media Retention

Uploaded and generated media files are automatically deleted after 30 days. For full details on how we handle your data, see our Privacy Policy.

13. Termination

You may delete your account at any time through the Pixshop app. Pixshop reserves the right to suspend or terminate your account at any time for violations of these Terms, with or without prior notice. Upon termination, your right to use the service ceases and your data will be deleted per our Privacy Policy. Termination does not entitle you to a refund of any unused credits or prepaid subscription fees.

14. Disclaimer of Warranties

The service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Pixshop does not warrant that the service will be uninterrupted, error-free, or that generated content will meet your expectations.

15. Limitation of Liability

To the maximum extent permitted by law, Pixshop shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the service. Pixshop's total liability to you for any claims arising under these Terms shall not exceed the amount you paid to Pixshop in the twelve months preceding the claim.

One-year claims deadline. Any claim or cause of action arising out of or related to your use of Pixshop or these Terms must be filed within one year after the claim arose. Claims not filed within this period are permanently barred.

16. Indemnification

You agree to indemnify, defend, and hold harmless Pixshop and its officers, employees, and contractors from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the service, your uploaded content, or your violation of these Terms.

17. Dispute Resolution & Arbitration

Any dispute arising from these Terms or your use of Pixshop shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, with proceedings conducted remotely or in Wilmington, Delaware. Pixshop will pay AAA filing fees for claims under $10,000. Either party may bring qualifying claims in small claims court. Nothing in this section prevents either party from seeking injunctive or equitable relief in court to protect intellectual property or confidential information.

Class action waiver. You waive the right to participate in any class action lawsuit or class-wide arbitration against Pixshop.

Arbitration opt-out. You may opt out of arbitration within 30 days of first accepting these Terms by emailing pixshop@1nano.tech with “Arbitration Opt-Out” in the subject line. Opting out does not affect any other provision of these Terms.

18. Force Majeure

Pixshop shall not be liable for delays or failures in performance resulting from causes beyond its reasonable control, including acts of God, government actions, internet or infrastructure outages, cyberattacks, or failure of third-party service providers (including AI API providers).

19. Modifications to Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. Continued use of Pixshop after a change takes effect constitutes acceptance of the updated Terms.

20. Severability & Entire Agreement

If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pixshop regarding your use of the service.

Survival. The following sections survive termination or expiration of these Terms for any reason: §6 (User Content & License), §9 (Biometric Data Consent), §14 (Disclaimer of Warranties), §15 (Limitation of Liability), §16 (Indemnification), §17 (Dispute Resolution & Arbitration), and §20 (Severability & Entire Agreement).

21. Assignment

You may not assign or transfer your account or any rights under these Terms without Pixshop's prior written consent. Pixshop may assign these Terms or any rights under them to a successor entity in connection with a merger, acquisition, or sale of substantially all of its assets, provided that the successor assumes Pixshop's obligations under these Terms. We will notify you of any such assignment.
